Arizona deadlines and fault

Most Arizona personal-injury and death-from-injury lawsuits must be commenced within two years after the cause of action accrues under A.R.S. § 12-542. The official title is Injury to person; injury when death ensues; injury to property; conversion of property; forcible entry and forcible detainer; two year limitation. Subsection 1 covers injuries to the person. Subsection 2 covers injuries when death ensues and treats the action as accruing at the death of the injured person. This hub does not treat § 12-542 as the standalone wrongful-death liability statute; who may sue is a different question under A.R.S. § 12-611 and A.R.S. § 12-612, which the wrongful-death city page covers in more detail.

Arizona follows pure comparative negligence. Under A.R.S. § 12-2505, contributory negligence and assumption of risk are jury questions. If the jury applies either defense, the claim is not barred; damages are reduced in proportion to the claimant's fault that was a proximate cause of the injury or death. There is no right to comparative negligence for a claimant who intentionally, wilfully, or wantonly caused or contributed to the injury or wrongful death. That is not Nevada's 51% bar.

If a city, county, state, or public employee may be involved (for example a government vehicle or a roadway-design claim), Arizona also has shorter public-entity clocks: a notice of claim within 180 days after accrual under A.R.S. § 12-821.01, and a lawsuit within one year under A.R.S. § 12-821.
